Welcome to Solo Branch Studio, a company registered and based in the Netherlands. By accessing our website or playing our games, you agree to be bound by these Terms of Service, which comply with Dutch law and EU regulations. Please read them carefully.

These Terms are governed by Dutch law. If you are a consumer within the European Union, you also benefit from mandatory provisions of consumer protection law in your country of residence.

Eligibility

Prohibited Activities

• Use cheats, exploits, automation software, bots, or any unauthorized third-party software
• Harass, abuse, or harm other users
• Upload or distribute viruses, malware, or any harmful code

3. User Accounts

Some of our Services may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and game design, are owned by Solo Branch Studio and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content without our prior written consent.

5. User-Generated Content

If you submit, post, or display content through our Services ("User Content"), you:

• Retain ownership of your User Content
• Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content in connection with our Services
• Represent that you have all necessary rights to your User Content
• Agree that your User Content does not violate any laws or third-party rights

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate.

6. Free-to-Play Games

Some of our games are provided free of charge. We reserve the right to modify, suspend, or discontinue any free game at any time without notice or liability.

7. In-Game Purchases (If Applicable)

Some of our games may offer in-game purchases. Virtual items or currency have no monetary value and cannot be exchanged for real money.

8. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from a purchase within 14 days without giving any reason, in accordance with the EU Consumer Rights Directive as implemented in Dutch law.

Exception for Digital Content: By starting to use or download digital content (such as games or in-game items) immediately, you explicitly agree to waive your right of withdrawal for that specific digital content, as permitted under Article 16(m) of the Consumer Rights Directive.

For free games and services, the right of withdrawal does not apply as there is no payment obligation.

9. Disclaimers

Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, to the extent permitted by law. We do not guarantee that our Services will be:

• Uninterrupted, timely, secure, or error-free
• Free of viruses or other harmful components
• Accurate, reliable, or correct

Note for EU Consumers: This disclaimer does not affect your statutory rights under EU and Dutch consumer protection law.

10. Limitation of Liability

To the fullest extent permitted by Dutch law, Solo Branch Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our Services
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or other harmful code that may be transmitted through our Services
• Any errors or omissions in any content
• Any user content or conduct of any third party

Note for EU Consumers: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under Dutch or EU law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Solo Branch Studio and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our Services or your violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our Services will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

If you are a consumer resident in the European Union, you also benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or our Services shall first be resolved through good faith negotiations.

For Business Users: If negotiations fail, disputes shall be exclusively resolved by the competent courts in the Netherlands.

For EU Consumers: If you are a consumer resident in the European Union, you may bring proceedings in either the courts of the Netherlands or the courts of your country of residence. We may only bring proceedings against you in the courts of your country of residence.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and Solo Branch Studio regarding our Services and supersede all prior agreements and understandings, except where additional mandatory consumer rights apply under applicable law.
